The Digital Millennium Copyright Act (DMCA) is a 1998 United States copyright law that was enacted to implement two treaties adopted by the World Intellectual Property Organization (WIPO) in 1996. The Act criminalizes the production and distribution of technology, devices, or services designed to circumvent access control measures (commonly known as digital rights management or DRM) for copyrighted works. The Act also criminalizes the circumvention of access controls, whether or not copyright infringement actually occurs. In addition, the DMCA increases penalties for copyright infringement on the Internet. The DMCA was passed unanimously by the United States Senate on October 12, 1998, and signed into law by President Bill Clinton on October 28. The Act amended Title 17 of the United States Code to expand copyright protection while limiting the liability of online service providers for copyright infringement by their users.
The DMCA's main innovation in the field of copyright is to exempt Internet service providers and other intermediaries from direct and indirect liability. The European Union adopted this exemption in the 2000 E-Commerce Directive. The 2001 Information Society Directive implemented the 1996 WIPO Copyright Treaty in the European Union.
Introduction
This policy is intended to implement the procedures set forth in Title II of the Digital Millennium Copyright Act (DMCA), 12 USC (Section 512(c)(3)). Pursuant to the Notice and Takedown Procedure, a copyright owner shall submit a notice containing a list of specified elements to the Service Provider’s Designated Agent, under penalty of perjury. If the statutory requirements are not substantially complied with, the Service Provider will not consider the notice in determining whether it possesses the requisite level of knowledge. If the Service Provider promptly removes or blocks access to the material identified in the notice upon receipt of proper notification, the Service Provider shall be exempt from liability for monetary damages.
In addition, the Service Provider shall not be liable for claims brought against any person resulting from the removal of material. Casahomelighting.com respects the legal protections provided by applicable copyright laws.
Designated Agent
Notices of alleged infringement should be sent to our Designated Agent. Upon receipt of a notice of claimed infringement, we will follow the procedures outlined on this page and in the DCMA.
Complaints filed with our designated agent will be forwarded to the Casahomelighting.com website content administrator within Casahomelighting.
Complaint Notification Procedure for Copyright Owners
Notifications of alleged copyright infringement sent to the designated agent must include the following.
An electronic or physical signature of the copyright owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Casahomelighting to locate the material.
Information reasonably sufficient to permit Casahomelighting to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Failure to include all of the above information may result in a delay in processing or DCMA notification.
Include both of the following statements in the body of the notification:
"I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as fair use)."
"I hereby declare that the information in this notification is accurate and, under penalty of perjury, that I am the owner of the copyright or exclusive right that is allegedly infringed, or am authorized to act on the owner's behalf."

Notice and Takedown Procedures
Casahomelighting will comply with applicable copyright laws. However, if Casahomelighting receives notification of claimed copyright infringement, or otherwise becomes aware of facts and circumstances that clearly indicate infringement, we will act expeditiously to remove or disable access to the material claimed to be infringing or the subject of infringing activity. If a counter notification is received by our designated agent, Casahomelighting will comply with the relevant provisions of the DMCA.
Repeat Infringers
In appropriate circumstances, Casahomelighting may, at its sole discretion, terminate the authorization of a repeat infringer to use our systems or networks.
Accommodation of Standard Technological Measures
It is Casahomelighting's policy to accommodate, rather than interfere with, standard technological measures used by copyright owners to identify or protect copyrighted works that we deem reasonable under the circumstances.
